1. Acceptance of Terms and AI Acknowledgment

⚠️ MANDATORY ACKNOWLEDGMENT: By accessing or using ParentBrief, you explicitly acknowledge and agree that:

  • All content analysis is generated by ARTIFICIAL INTELLIGENCE (AI)
  • AI is NOT 100% accurate and may produce errors or miss inappropriate content
  • You will NOT rely solely on AI analysis for parenting decisions
  • YOU are solely responsible for determining what media your children consume
  • ParentBrief is NOT LIABLE for AI errors, omissions, or inaccuracies
  • You CANNOT sue ParentBrief for harm resulting from AI-generated information
  • You assume ALL RISK when using AI-generated content analysis

IF YOU DO NOT AGREE TO THESE TERMS, INCLUDING THE AI LIMITATIONS AND LIABILITY WAIVERS, DO NOT USE PARENTBRIEF.

The terms and conditions set forth below (the "Terms") govern your use of the website located at parentbrief.com (the "Site") and any services available on the Site (collectively, the "Services"). These Terms are a legal contract between you and ParentBrief and govern your access to, and use of, the Services and the Site. If you do not agree with any of these Terms, do not access or otherwise use this Site, the Services or any information contained on this Site. Your use of this Site and/or the Services will be deemed to be your agreement to abide by each of the Terms set forth below.

We may make changes to the content and the Services offered at any time by posting updated Terms of Service on the Site and by sending registered users an email notice of the changes. We may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability. If any modification is unacceptable to you, you will cease using the Site or Services. If you do not cease using the Site or Services, you will be deemed to have accepted the change.

ParentBrief may, in its sole discretion, refuse to offer the Services to any person or entity and change its eligibility criteria at any time. This provision is void where prohibited by law, and the right to access the Services is revoked in such jurisdictions. Use of the Services is also subject to ParentBrief's Privacy Policy, which is incorporated into these Terms by this reference.

You represent, acknowledge and agree that you are of legal age to enter into the Terms, or, if you are not, that you have obtained parental or guardian consent to enter into and agree to these Terms. If your acceptance of these Terms is on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Services and Registration

ParentBrief utilizes artificial intelligence systems to analyze and provide safety information about books, movies, TV shows, video games, and other media content (collectively, "Content Analysis"). In order to access certain features of the Services, you may need to register through the Site.

Upon successful registration, you become a member of the Website (a "Member"), and for as long as you remain a Member, you agree to comply with the then applicable Terms. All Services are licensed and not sold. Each user must have a unique account, and you are responsible for any activity conducted on your account.

You must not make available to other people your account username or password or otherwise share with other people access to your account. A breach or violation of any of these Terms may result in an immediate termination of your right to use the Services and ParentBrief reserves the right to ban you and any IP address or other identifier associated with you or your account.

3. Fees and Payments

ParentBrief offers both free and paid subscription Services. You can learn more about ParentBrief's subscription options on the Site. Paid subscriptions are available on a monthly or yearly basis, payable in U.S. dollars, and will automatically renew according to the selected billing cycle. You may stop using the Services and cancel your subscription at any time through the website or by emailing support@parentbrief.com.

Payments are non-refundable, except where required by law. This means that if you cancel your subscription—or if ParentBrief terminates your right to use the Services due to a breach of these Terms—you will not receive a refund or credit for amounts already billed or paid. ParentBrief may change its pricing at any time; for subscribers, price changes will take effect at the next renewal or thirty (30) days after notice to you, whichever is later.

3.1 Taxes

Unless otherwise stated, your subscription fees ("Fees") do not include federal, state, local, or any foreign taxes, duties, and other similar assessments ("Taxes"). You are responsible for all Taxes associated with your purchase of a subscription and ParentBrief may invoice you for such Taxes.

3.2 Usage Limits

Content analysis requests may be subject to usage limits based on your subscription tier. Free accounts have daily limits on the number of content analyses that can be performed. Premium subscriptions offer increased or unlimited analysis requests. Usage limits reset based on your billing cycle.

4. Licensing Terms

4.1 Service License

Subject to your compliance with these Terms, and any applicable laws or other limitations, ParentBrief grants you a non-exclusive, limited, non-transferable, non-sublicensable, non-assignable, freely revocable license to access and use the Services for personal, non-commercial use subject to the limitations and restrictions of the subscription tier associated with your account.

4.2 Content Analysis Reports

The content analysis reports, safety ratings, and recommendations provided by ParentBrief ("Reports") are for informational purposes only. You may use the Reports for personal decision-making regarding media consumption for your family. You may not:

  • Republish or redistribute Reports for commercial purposes
  • Use Reports to train artificial intelligence models or systems
  • Scrape, harvest, or systematically collect Reports from the Services
  • Remove or obscure any attribution or branding from Reports

5. Member Responsibilities and Restrictions

5.1 Acceptable Use

As a condition of use, you agree not to use the Services for any purpose that is prohibited by these Terms. You shall not:

  • Violate any applicable law, rule, or regulation
  • Infringe upon any intellectual property rights of others
  • Use the Services in any threatening, abusive, harassing, or defamatory manner
  • Attempt to gain unauthorized access to the Services or related systems
  • Interfere with or disrupt the Services or servers
  • Use automated systems to access the Services without authorization
  • Reverse engineer or attempt to extract the source code of the Services

5.2 Content Submissions

When you submit content titles, images, or other information to the Services for analysis, you represent and warrant that you have the right to submit such information and that your submission does not violate any third-party rights or applicable laws.

6. Term and Termination

Subject to this Section, these Terms will remain in full force and effect while you use the Services. ParentBrief may terminate your access to all or any part of the Services at any time if you fail to comply with these Terms, which may result in the forfeiture and destruction of all information associated with your account.

If you wish to terminate your account, you may do so by following the instructions on the Services or by contacting support. You understand that any termination may involve deletion of your data from our databases. ParentBrief will not have any liability whatsoever to you for any termination of your rights under these Terms. Any Fees paid hereunder are non-refundable.

7. AI Technology Disclaimers and Limitations

⚠️ CRITICAL NOTICE: BY USING PARENTBRIEF, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING AI-RELATED LIMITATIONS AND DISCLAIMERS:

7.1 AI-Generated Content Analysis

ALL content analysis, safety ratings, age recommendations, and reports provided by ParentBrief are generated by artificial intelligence (AI) systems. AI technology, by its nature, is NOT 100% accurate and may produce errors, omissions, or incorrect assessments.

7.2 No Guarantee of Accuracy

ParentBrief DOES NOT guarantee, warrant, or represent that:

  • AI-generated content analysis will be accurate, complete, or error-free
  • Content flagged as "safe" or "appropriate" is actually suitable for your child
  • All inappropriate content, themes, or material will be detected or reported
  • Age recommendations align with your family's values or standards
  • The AI will identify all violence, language, sexual content, or mature themes
  • Cultural, religious, or personal sensitivities will be accurately assessed

7.3 Parental Responsibility

YOU, as the parent or guardian, are SOLELY and EXCLUSIVELY responsible for:

  • Making final decisions about what media your children consume
  • Independently verifying any information provided by ParentBrief
  • Supervising your children's media consumption
  • Determining age-appropriateness based on your child's individual maturity
  • Reviewing content yourself before allowing your children to access it

7.4 AI Errors and Omissions

You expressly acknowledge and agree that AI systems may:

  • Incorrectly classify content as safe when it contains inappropriate material
  • Miss or fail to detect violence, profanity, sexual content, or mature themes
  • Provide inaccurate age recommendations that do not match actual content
  • Misinterpret context or cultural nuances in media
  • Generate false positives by flagging appropriate content as inappropriate
  • Fail to identify new, emerging, or subtle content concerns

7.5 Informational Tool Only

ParentBrief is an INFORMATIONAL TOOL ONLY and should be used as ONE FACTOR among many in your parenting decisions. Our AI analysis is NOT a substitute for:

  • Your own judgment and parental discretion
  • Personal review of media content
  • Professional child development advice
  • Official content ratings from MPAA, ESRB, or other rating organizations
  • Reviews from trusted sources and other parents

7.6 No Professional Advice

ParentBrief does NOT provide professional advice of any kind, including but not limited to: psychological advice, child development guidance, educational recommendations, or medical opinions. Our Services are not a substitute for professional consultation with qualified experts.

7.7 General Service Disclaimers

To the maximum extent permitted by applicable law, this Site, the Services, and any information or material contained or presented on this Site is provided to you on an "AS IS," "AS AVAILABLE," and "WHERE-IS" basis with NO WARRANTY of any kind, including but not limited to warranties of:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement of third-party rights
  • Accuracy or completeness of information
  • Uninterrupted or error-free operation

7.8 Acknowledgment of AI Limitations

BY USING PARENTBRIEF, YOU EXPLICITLY ACKNOWLEDGE, UNDERSTAND, AND AGREE THAT:

  • AI technology is inherently imperfect and subject to errors
  • You will NOT rely solely on ParentBrief's AI analysis for parenting decisions
  • You assume ALL RISK associated with using AI-generated information
  • ParentBrief is NOT LIABLE for any AI errors, omissions, or inaccuracies
  • You will independently verify information before making decisions affecting your children

8. Indemnity and Hold Harmless

You agree to defend, indemnify, and hold completely harmless ParentBrief, its parent companies, subsidiaries, affiliates, and each of its and their respective officers, directors, employees, contractors, agents, suppliers, licensors, AI technology providers, and representatives from any and all liabilities, losses, claims, demands, damages, expenses, and costs, including reasonable attorneys' fees, that arise from or relate to:

  • Your use or misuse of, or access to, the Services
  • Your violation of these Terms or any applicable law, contract, policy, regulation, or other obligation
  • Any decisions made based on information, analysis, or recommendations provided by the Services or AI systems
  • Any harm, injury, or damage to your children resulting from media consumption decisions
  • Any reliance on AI-generated content analysis, safety ratings, or age recommendations
  • Any AI errors, omissions, inaccuracies, or failures to detect inappropriate content
  • Exposure of your children to inappropriate, harmful, or unsuitable content that was analyzed by ParentBrief
  • Any breach of your responsibilities as a parent or guardian
  • Any claims by third parties related to your use of the Services

This indemnification obligation will survive termination of your account and your use of the Services.

9. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARENTBRIEF SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING FROM YOUR USE OF THE SERVICES.

9.1 Complete Disclaimer of Liability

You understand and expressly agree that IN NO EVENT shall ParentBrief, its officers, directors, employees, contractors, agents, affiliates, or AI technology providers be liable to you or any third party for ANY damages of any kind, including but not limited to:

  • Direct damages arising from AI errors or inaccuracies
  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Emotional distress or psychological harm to you or your children
  • Physical harm or injury resulting from media consumption
  • Exposure to inappropriate content that was incorrectly classified as safe
  • Developmental, behavioral, or educational impacts on your children
  • Decisions made in reliance on AI-generated information
  • Failure of AI systems to detect harmful content
  • Any other damages arising out of or in connection with the Services

This limitation applies WHETHER OR NOT ParentBrief has been advised of the possibility of such damages, and regardless of the legal theory upon which liability is based (contract, tort, negligence, strict liability, or otherwise).

9.2 AI-Specific Liability Limitations

ParentBrief is specifically NOT LIABLE for:

  • AI classification errors that result in inappropriate content being marked as safe
  • Failure of AI to detect violence, profanity, sexual content, or mature themes
  • Inaccurate age recommendations provided by AI systems
  • AI misinterpretation of content context or cultural sensitivities
  • Technical failures, bugs, or errors in AI algorithms
  • Changes in AI performance or accuracy over time
  • Limitations inherent in current AI technology

9.3 Assumption of Risk

BY USING PARENTBRIEF, YOU VOLUNTARILY ASSUME ALL RISKS associated with relying on AI-generated information for parenting decisions. You acknowledge that you are using the Services AT YOUR OWN RISK and that ParentBrief cannot and does not guarantee the safety or appropriateness of any media content.

9.2 Limitation of Direct Damages

Our liability to you for any damages arising from or related to this agreement will at all times be limited in the aggregate to the greater of fifty US dollars (U.S. $50), or the amount paid by you to ParentBrief in the six (6) months immediately prior to the date of the event giving rise to such asserted claim.

10. Privacy and Data Protection

Your use of the Services is subject to ParentBrief's Privacy Policy. We process and store information in the United States and other countries. By using our Services you authorize ParentBrief to transfer your personal information across national borders and to other countries where ParentBrief and its partners operate.

ParentBrief takes the privacy and safety of children seriously. We do not knowingly collect personal information from children under 13 without parental consent. If you believe we have inadvertently collected such information, please contact us immediately.

11. Copyright and Intellectual Property

ParentBrief respects intellectual property rights. The content analysis provided by our Services is based on publicly available information about media content. If you believe that material on our Services infringes your copyright, you may send a written notice to legal@parentbrief.com.

All trademarks, service marks, logos, and trade names displayed on the Services are the property of ParentBrief or their respective owners. You may not use any such marks without the prior written permission of ParentBrief or the applicable owner.

12. Governing Law

This Agreement will be governed by and interpreted in accordance with the laws of the State of Delaware, without giving effect to any conflict of law principles. Any disputes arising out of or relating to this Agreement will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

13. General Provisions

These Terms of Service, including the Privacy Policy and all other terms and conditions incorporated herein, constitute the entire agreement between you and ParentBrief regarding the use of the Service. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.

If any provision of these Terms is held to be invalid or unenforceable, the other provisions of these Terms will remain in effect, and the invalid or unenforceable provision will be deemed modified to the maximum extent permitted by law.

These Terms, and your rights and obligations herein, may not be assigned, subcontracted, delegated, or otherwise transferred by you without ParentBrief's prior written consent. ParentBrief may assign, transfer, or delegate any of its rights and obligations hereunder without your consent.
